Spill Challenges on Construction Sites

Construction sites are among the most difficult environments to manage spill risk. Equipment moves constantly, fuel storage locations change with project phases, and there is rarely permanent infrastructure like floor drains or concrete containment berms to rely on. Yet the regulatory obligations are just as real as they are for any fixed industrial facility.

EPA's National Pollutant Discharge Elimination System (NPDES) Construction General Permit requires stormwater pollution prevention plans (SWPPP) that address spill prevention, fueling area management, and drain protection at all sites disturbing one or more acres. State environmental agencies often add additional requirements on top of federal minimums. A single stormwater violation can result in stop-work orders, fines of $25,000 per day, and costly remediation.

The good news: construction-specific spill containment products are lightweight, portable, and designed to set up in minutes without tools. Foam-wall containment berms deploy instantly around equipment. Drain plugs seal storm drains in seconds. Portable spill kits travel easily from site to site in service trucks. At Spill Ready Supplies, we stock everything a contractor or site safety officer needs to run a clean, compliant jobsite.

Equipment Fuel Leaks

Excavators, bulldozers, cranes, and generators all carry significant quantities of diesel, hydraulic fluid, and lubricating oil. Hydraulic hose failures and fuel system leaks are among the most common spill events on active construction sites.

Temporary Fuel Storage

Bulk diesel storage tanks and drum fuel depots on construction sites must have secondary containment under EPA SPCC and NPDES rules. Portable berms provide compliant containment without permanent installation.

Stormwater Drain Protection

One of the most cited NPDES violations is failure to protect storm drains from construction-related discharge. Drain plugs and covers must be deployed whenever fueling, concrete washing, or other activities occur near inlets.

Concrete Washout & Chemical Spills

Concrete washout is highly alkaline and toxic to waterways. Chemical containers for adhesives, sealants, and form release agents must be stored with secondary containment to prevent spills from entering soil and groundwater.

Portable & Temporary Containment

Unlike fixed facilities, construction sites need containment that moves with the job. Modular berms, foam-wall duck ponds, and portable spill kits are designed specifically for this—they set up and break down in minutes, travel in a truck bed, and deploy anywhere on site.

SWPPP Compliance

Your SWPPP must document spill prevention measures, identify responsible parties, and specify on-site spill response materials. Having the right products on-site—and the inspection records to prove it—is essential for staying current with your permit obligations.

Frequently Asked Questions — Construction Site Spill Control

What spill control products are required in a construction SWPPP?

Your SWPPP must identify materials that could contaminate stormwater and describe the containment measures in place. At a minimum, most SWPPPs specify: secondary containment for all fuel and chemical storage (drums, tanks), drain plug covers for stormwater inlets near fueling areas, portable spill kits at designated fueling and maintenance locations, and absorbent materials for cleaning up minor spills before they reach inlets.

What size containment berm do I need for a construction fuel tank?

The berm must contain 110% of the tank's capacity. For a 500-gallon portable fuel tank, your containment berm must hold at least 550 gallons. Our foam-wall berms and modular berm kits are available in multiple sizes—select the berm area size that gives you the required containment volume based on the berm wall height. Contact us for help calculating the right size for your specific tank.

How do foam-wall duck pond berms work?

Foam-wall duck ponds use flexible foam blocks bonded into a PVC liner. When the berm is unrolled, the foam walls spring upright automatically—no tools, no inflation, no assembly required. Heavy equipment can drive over the foam walls to enter the containment zone; the walls spring back up after the vehicle passes. These are one of the most practical spill containment solutions for construction sites because they deploy and relocate in minutes.

When are drain plug covers required on a construction site?

Drain plugs should be deployed whenever any activity occurs near a storm drain inlet that could generate polluted runoff: fueling operations, concrete washout, painting, equipment maintenance, and chemical applications. Under EPA's NPDES permit and most state permits, failure to protect storm drains from construction-related discharge is a permit violation subject to significant fines.

Can I use the same spill kit for oil and concrete washout?

No. Spill kits for petroleum spills contain oil-only or universal absorbents designed for hydrocarbon fluids. Concrete washout requires dedicated washout containment structures—typically lined pits or portable washout containers. Universal absorbent pads can absorb small washout spills, but they are not a substitute for proper washout containment as required by your SWPPP.

Do I need a spill kit in every service truck?

Most SWPPP templates and state environmental requirements specify that spill response materials must be available wherever potential spill sources exist. Practically, this means a compact spill kit in every service truck, at every fueling point, and at every equipment maintenance area on the jobsite. Our compact jobsite spill kits are sized specifically to fit in truck toolboxes and equipment cabs.

Are portable berms and drain plugs reusable?

Yes. Foam-wall duck ponds, modular berms, L-bracket berms, and drain plugs are all reusable and designed to relocate with the project. Clean them between uses and inspect for any PVC liner damage or berm wall degradation. Absorbent pads and spill kit consumables are single-use and should be disposed of as regulated waste after absorbing petroleum or hazardous materials.

What is the penalty for a stormwater spill violation on a construction site?

Under EPA NPDES, civil penalties for permit violations can reach $25,000 per day per violation. Criminal penalties for negligent violations start at $2,500 per day. State agencies often have concurrent enforcement authority with additional penalty structures. A single inadequately protected storm drain during a rain event can trigger a significant enforcement action—the cost of a drain plug is a fraction of the potential fine.
